Carbon County court — DUI

A Kresgeville man admitted to two drunken driving charges. He was one of three people to appear Thursday before President Judge Roger N. Nanovic II in Carbon County court to enter guilty pleas.

Palmerton incidents

Nelson Geigel-Cuenca

, 24, pleaded to two driving under the influence of a controlled substance counts for incidents in Palmerton.

The first arrest occurred on Feb. 19, 2017, along Delaware Avenue and the second on March 12, 2017, along Avenue A, after he was involved in a hit-and-run accident. In that incident he also pleaded to counts of accidents involving damage to unattended vehicle, driving under suspension and possession of drug paraphernalia. In the second case Geigel-Cuenca was found a distance from the accident scene. While taking him into custody, officers found drug paraphernalia on him and also learned his license was under suspension.

Nanovic deferred sentencing because Geigel-Cuenca needs to obtain a drug and alcohol evaluation.

He is currently an inmate in the county prison.

Other pleas

Patricia A. Hutta

, 54, of Lehighton, pleaded to one count of retail theft, her second offense. She was arrested on Oct. 12, 2017, by Lehighton police for stealing items form the Dollar General Store along North First Street.

Nanovic, in accepting the plea, warned Hutta that any future retail theft convictions would make it a felony offense and possible jail time.

Nanovic placed her on probation for a year and ordered her to make restitution to the victim for $28.50, pay court costs of about $1,000 and pay a $50 per month supervision fee while on probation.

Joshua M. Schaeffer

, 38, of Lehighton, pleaded to one count of possession of drug paraphernalia. He was arrested on Oct. 16, 2017, following a traffic stop by Lehighton police in the area of Route 209 and Maine Lane. Schaeffer was a passenger in the vehicle.

Nanovic placed him on probation for a year and ordered he get a drug and alcohol evaluation, zero tolerance for drug or alcohol use, pay court costs of about $1,000 and pay a $50 per month supervision fee while on probation.

Sentenced

Ryan M. Rehrig

, 37, of Palmerton, was sentenced on a DUI charge. He previously pleaded guilty to the count and a charge of possession of drug paraphernalia.

On the DUI charge Nanovic sentenced him to serve two to six months in jail, a fine of $2,500, one-year license suspension, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole and probation. On the paraphernalia charge he was placed on probation for a year consecutive to the DUI charge.

He was arrested on Sept. 3, 2017, by Palmerton police along Delaware Avenue.

He is currently in the county prison on a detainer filed by the state parole board for a parole violation. Resentencing on that charge is pending.
