A New York state man was sentenced to a county prison term Thursday in Carbon County court after previously pleading to a drug charge.
Judge Joseph J. Matika sentenced Joel Enrique Cabrera, 22, of the Bronx, to serve six to one day less 24 months in prison on a charge of possession with intent to deliver a controlled substance - heroin.
Cabrera was stopped along Interstate 80 westbound by state police at Fern Ridge on Dec. 3, 2016. About 10 grams of heroin along with various drug paraphernalia were found in the vehicle.
Although there were others in the vehicle at the time of the stop, Cabrera took responsibility for all the drugs troopers found.
Defense Attorney Edward M. Olexa asked Matika to consider a probation term.
Matika rejected that request, stating he saw no mitigating circumstances in the case but said because of his cooperation with police at the stop, he would give him a sentence at the low end of state sentencing guidelines.
In addition to the prison term, Matika ordered Cabrera to get a drug and alcohol evaluation, supply a DNA sample, get his GED, pay court costs of about $1,000, and when released on parole pay a $50 per month supervision fee and render 25 hours of community service.
He began the prison term immediately and was given credit for 12 days spent in jail on the charge to date.
