A Carbon County man was sentenced to a state prison term in the county court on Tuesday after pleading guilty to a gun possession count and a recklessly endangering charge.
Duane Dubernas, 64, of White Haven, was sentenced by Judge Joseph J. Matika to serve 21 to 48 months in a state correctional institution on the gun possession count and six to 12 months on the recklessly endangering charge, with the terms running concurrently.Dubernas was arrested on both counts on March 14 when Kidder Township police responded toa residence on Helen Way in Pocono Lake to a report of shots fired. On scene officers learned that Dubernas was observed outside a vehicle firing a shotgun in the direction of the residence. His wife was inside the home. No one was injured in the incident.When taken into custody, police learned that Dubernas had an active warrant for his arrest out of Lancaster County.Matika told Dubernas he was fortunate that he was charged with unlawful possession of a firearm as a fugitive and not unlawful possession by a felon. The prison term would have been longer.Since the incident, Dubernas was returned to Lancaster County and was sentenced on charges there to serve 18 to 36 months in a state prison. Matika ruled his sentence would run concurrent with Lancaster County. Dubernas must also render 100 hours of community service when paroled, supply a DNA sample, get a drug and alcohol evaluation, zero tolerance for drug and alcohol use and pay court costs of about $1,000.He was given credit for 166 days spent in prison on the charges.
