Lawsuit against Lansford heads to court

A Lansford business owner's suit against the borough will get its day in county court.

Jesse Hiles, a borough resident and owner of the Sports Zoo bar, claims that the borough's storm drains have damaged his property. He says in his suit that the drains were intentionally designed to do so.The suit will be heard at 1:15 p.m. July 25 before Judge Steven R. Serfass.Hiles first filed the suit last August, after warning the borough of legal action in a letter in May. In his suit, Hiles provided an estimate saying the work to fix the problem would cost about $12,960.He said the problem began after the borough graded and paved the intersection of West Ridge Street and Cortright Street.The borough says that Hiles property is being damaged by stormwater because it's on a hill. On top of that, they said, Hiles has refused to install a legally required curb around his property, which would take care of the problem.In their response, the borough's attorney said that Hiles' estimate for the work included more than $4,000 worth of curbing that the property owner, not the borough, is responsible for.An attempt at remedying the problem backfired, according to Hiles. The borough dumped some gravel on the property in an attempt to channel the water away from his property, but it ended up causing more erosion, Hiles said.The issue dates back at least six years. According to published reports, Hiles brought up the stormwater issues at a council meeting in 2011. At that time, council voted to handle the issue in-house, according to the article.The hearing will be held in Courtroom 3 at the Carbon County Courthouse.
