An elderly Schuylkill County man was sentenced to a state prison term Monday in Carbon County court on a corruption of a minor charge, rated as a felony two.
Stephen Olman, 80, of McAdoo, was sentenced by Judge Steven R. Serfass to serve five to 24 months in a state correctional institution. He previously pleaded to the charge.Serfass rejected a request by Olman's attorney, John M. Solt, to placed his client on probation citing his age, military service, no prior convictions and health issues he suffered.Serfass said after reviewing the comprehensive presentence investigation report prepared by the adult probation office and the facts of the case, a probation sentence, which would be in the mitigated range of sentencing guidelines, was not appropriate. Serfass also noted a prior arrest of Olman on similar charges were reduced to a summary offense.Olman told Serfass, "I'm sorry that I done this. I tried to apologize."State police at Lehighton charged that on July 24, 2016, Olman was at a residence along Porter Drive in Penn Forest Township when he entered a bedroom where a 13-year-old boy was sleeping.When the boy woke up, Olman made sexual advances, which the victim refused and told him to leave. Olman left the bedroom but returned a short time later and tried again. The boy's family then notified state police.The charge falls under the provisions of Megan's Law. An evaluation by the state sexual assessment board found that Olman was not a violent sexual predator. However, he must register for the next 15 years as a sexual offender.Serfass also ordered Olman to get a mental health evaluation, have no contact with the victim, supply a DNA sample, submit to a sexual offenders evaluation and pay court costs of about $1,000.He will report to the county prison in Nesquehoning on May 26 at 9 a.m. and later be transferred to a state facility.
