Northampton man admits to three drug counts
A Northampton County man pleaded guilty on Monday in Carbon County court to three drug counts before President Judge Roger N. Nanovic II.
Daniel Robert Giniewski, 42, of Walnutport pleaded to one count of possession of a controlled substance and two counts of possession of drug paraphernalia.He was arrested on the first paraphernalia charged on April 25, 2016, at a home on the 200 block ofLehigh Avenue, Palmerton, where state police at Lehighton served a search warrant. Various drug paraphernalia and a bag of methamphetamine were found in the residence. In a plea agreement with the district attorney's office a charge of possession was dropped.The second paraphernalia charge occurred on June 26, following a vehicle stop along Route 248 by state police at Lehighton. Giniewski was a passenger in the vehicle and was found with drug paraphernalia. A possession count was dropped in a plea bargain.The possession charge also occurred on June 26 when Giniewski was taken to the county prison in Nesquehoning.While being processed into the prison, corrections officers found a baggie of methamphetamine on him. Charges of contraband-controlled substance into a prison, a felony two, and possession of paraphernalia were dropped in a plea bargain.Giniewski told the court he is currently involved in a drug counseling program run at the Veterans Hospital in Wilkes-Barre, attending sessions three days a week.He claimed he got involved in the drug culture by a girlfriend, who eventually died of a drug overdose earlier this year.On the possession of a controlled substance count, Nanovic sentenced him to serve one to 12 months in the county prison and also ordered him to get a drug and alcohol evaluation and follow any recommendations for treatment and zero tolerance imposed on drug or alcohol use.On the two paraphernalia charges, he was placed on probation for six months with the terms running concurrent to each other but consecutive to the first count.He begins the jail term at 10 a.m. on May 5 and will serve it on consecutive two-day weekends.
