Gabory, 730 Indian Hill Road, Lehighton, Virginia Valis, 700 Red Hill Road, Lehighton, and Franklin Township, a municipal corporation, 889 Fairyland Road, Lehighton, as defendants.The suit states on Aug. 19, 2016, at 5:15 p.m. the plaintiff was driving on Indian Hill Road in Franklin Township, in an easterly direction approaching the intersection with Red Hill Road, while defendant Piekarski was southbound on Indian Hill Road allegedly at a high rate of speed when he failed to stop for a posted stop sign. His vehicle collided into the driver's side door of the plaintiff, causing serious injuries which are detailed in the suit.The suit further states that Piekarski said he did not see the stop sign. The suit goes on to state upon investigation it is believed at the time of the accident a row of pine trees existed along the right hand or westerly side of Red Hill Road which had numerous large branches extending well into the right of way of Red Hill Road.The suit states that defendants Gabory were owners of the property where the pine trees are located and rented the property to defendant Valis. Also, at the time of the accident the township had control and possession of the right of way of Red Hill Road and was responsible for the maintenance of the roadway and in addressing safety hazards located within the right of way.Negligence is alleged against all the defendants and sought are damages in an amount that "exceeds the jurisdiction limit for arbitration" in Carbon County.
