Motor vehicle tort charge

Kimberly and Michael Colleran, Pittston Township, have filed a civil action against Jo Pazych, 207 Poplar Drive, Albrightsville, over a motor vehicle tort claim.The action, started by a writ of summons in which the specifics of the suit do not have to be listed, seeks damages in excess of the court's $50,000 limits of arbitration. A jury trial is demanded.Justice Dept. files judgmentThe U.S. Department of Justice has filed a court-imposing judgment against Crystal Serfass, formerly of Junedale, Banks Township, in relation to fines and restitution she owes for her role in armed robberies of four banks and a store.Serfass, 32, is serving a federal prison term of 90 months, handed down by U.S. District Judge James M. Munley of the Middle District of Pennsylvania. She pleaded guilty to her role as getaway driver in the armed robberies of the Jim Thorpe National Bank, Penn Forest Township, on Sept. 17, 2013; National Penn Bank, Drums, on Aug. 8, 2014; Jim Thorpe Neighborhood Bank, Penn Forest Township, on Nov. 18, 2014; ESSA Bank and Trust, Brodheadsville, on Dec. 26, 2014; and the Dollar General, Nesquehoning, on Nov. 16, 2014.A co-defendant, David Weaver, 42, who in each of the robberies brandished a firearm to intimidate the employees, is serving a sentence of 121 months imprisonment.The lien against Serfass, filed Dec. 23, is in the amount of $22,546 and represents restitution imposed as part of Judge Munley's sentencing order pursuant to the federal government's Anti-Terrorism and Effective Death Penalty Act of 1996.Complaints in ejectmentTwo complaints in ejectment have been filed against defendants who the plaintiffs allege refuse to deliver up possession of premises bought by the plaintiffs at sheriff's sales as the result of mortgage foreclosure complaints.PNC Bank N.A., Columbus, filed against Verdell A.W. Felter, 252-254 S. Seventh St., Lehighton. The bank states it became the owner of the premises at that address by virtue of a deed recorded in its favor on Oct. 26, 2016, following the sale.Wells Fargo Bank N.A., Fort Mill, South Carolina, filed against Bryan S. Cullen, 400 Lake Drive, Nesquehoning. The bank states it became the owner of the premises at that address by virtue of a sheriff's sale held Oct. 14, 2016, and a deed recorded on Dec. 13, 2016.In both cases, the banks are seeking orders of ejectment from the court for the defendants to relinquish possession of the properties.Debt collection actionsThe Bank of America N.A., Newark, Delaware, has filed two debt collection suits against separate defendants.The first action lists Wayne Emerson Snyder Jr., 3191 Mahoning Mountain Road, Lehighton, as the defendant, seeking judgment against him in the amount of $9,943.41, plus costs.The second suit lists Barry D. Hoffman, 1207 Fairyland Road, Lehighton, as the defendant, seeking judgment against him in the amount of $21,614.47, plus costs.In both actions, the plaintiff states it is the successor-in-interest to FIA Card Services N.A., formerly known as MBNA America Bank N.A., which granted the consumer finance accounts to the defendants.Mortgage foreclosureWells Fargo Bank N.A., successor by merger to Wachovia Bank N.A., Sioux Falls, South Dakota, has filed a mortgage foreclosure complaint against Penny A. Kelemen and the Richard D. and Anna A. German Irrevocable Asset Protection Trust of Nov. 13, 2008, with addresses of 903 W. Lizard Creek Road, Lehighton, over a property over that address. Kelemen is listed as the trustee of the trust.Sought is judgment in the amount of $113,590.66, plus interest and costs.
