A Lehighton man admitted threatening his neighbor by displaying a gun at her.
On Monday Todd B. Costenbader, 53, pleaded guilty in Carbon County court to one count of simple assault before Judge Joseph J. Matika.Costenbader admitted displaying a gun in the direction of his neighboron May 23 at her residence along Lower Nis Hollow Drive in Mahoning Township.Township police responded to the scene and found two weapons in Costenbader's home. The weapon the neighbor said she saw Costenbader holding was a black plastic BB gun.Defense attorney Paul Levy told the court that Costenbader has mental health issues, which he is addressing. He also is currently homeless.Matika sentenced him to serve six to 18 months in prison with credit for 204 days already served. He was also ordered to get a mental health evaluation and follow all recommendations for treatment, have no contact with the victim, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole.Matika also said Costenbader must submit a preparole plan to the adult probation office before he can be released from jail. That plan must include a place of residence for the defendant.
