Carbon County court - Parole and probation revocation

Carbon County judges conducted parole/probation revocation hearings on petitions filed by the adult probation office against defendants who violated the terms of their release.

Zoey Bartenope, 19, of Nesquehoning, had her parole revoked on a charge of possession with intent to deliver a controlled substance on petition of probation officer Kimberly Cooper for violating conditions by failing to report to the probation office within 72 hours of her release on parole and not living at her approved residence.President Judge Roger N. Nanovic II resentenced her to serve out her maximum term, which runs to Nov. 24, followed by three years consecutive probation.Nicholas Kaszytski, 30, of Lehighton, had his parole revoked on a charge of criminal trespass on petition of probation officer Jillian C. McGinley for violating conditions by not keeping contact with McGinley, testing positive for controlled substances on two occasions and being unsuccessfully discharged from the Salvation Army inpatient, long-term treatment program.Judge Steven R. Serfass resentenced him to serve out his maximum term, which runs to Jan. 12, 2017.Czar Founds, 19, of Lehighton, had his probation revoked on a charge of prohibited offensive weapon on petition of McGinley for violating conditions by testing positive for marijuana on five occasions and failing to successfully complete drug and alcohol treatment.Judge Joseph J. Matika resentenced him to serve 60 days to 12 months in prison effective Aug. 11.Daniel D. Berger, 27, of Ranshaw, Northumberland County, had his probation revoked on a charge of simple assault on petition of McGinley for violating conditions by failing to report to the probation office as directed and his whereabouts were unknown.Matika resentenced him to serve four to 12 months in prison effective Aug. 1.Elizabeth Kane, 22, of Palmerton, had her probation revoked on a charge of possession of drug paraphernalia on petition of Cooper for violating conditions by testing positive for opiates, which violated the zero tolerance condition.Matika resentenced her to serve two to 12 months in prison effective July 25 and must submit a pre-parole plan before her release.Tyler Billings, 24, of Palmerton, had his probation revoked on a charge of accident involving damage to a vehicle on petition of Cooper for violating conditions by testing positive for alcohol, which violated the zero-tolerance condition.Nanovic resentenced him to serve four to eight months in prison effective April 6.Amber Defiore, 23, of Lehighton, had her probation revoked on a charge of resisting arrest on petition of McGinley for violating conditions by failing to submit to a urine screen and failing to obtain a drug and alcohol evaluation and follow all recommendations.Nanovic resentenced her to serve six to 12 months in prison effective March 17.ARD revokedTwo defendants previously placed in the Accelerated Rehabilitation Disposition probation program were revoked from it for violating conditions.Michael Bollinger, 42, of Lehighton, was placed in the program on a charge of terroristic threats and was revoked on petition of Cooper for violating conditions by failing to report to the probation office as directed, failing to report for a scheduled urine screen, testing positive for amphetamine, failing to complete drug and alcohol treatment and failing to submit documentation of mental health treatment.Jacqueline Heydt, 25, of Albrightsville, was revoked on a charge of retail theft on petition of probation officer Joseph Bettine for violating conditions by being arrested on new criminal charges, failing to pay court costs and failing to complete 50 hours of community service.Both had their cases placed on the next available trial list.
