Carbon County court - Parole, probation

Carbon County judges conducted parole/probation revocation hearings recently against defendants who violated the terms of their release.

Melissa Peters, 26, of Lehighton, had her probation revoked on a charge of possession of drug paraphernalia on petition of probation officer Jillian C. McGinley for violating conditions by failing to report to the probation office as directed, having new criminal charges filed against her, testing positive for marijuana, failing to submit to a urine screen and failing to engage in drug and alcohol treatment.President Judge Roger N. Nanovic II resentenced her to serve one to four months in the county prison, with the court ruling she must serve the entire four months. The sentence is effective Dec. 2, 2015.Marissa Nicole Fethiere, 22, of Lehighton, had her probation revoked on a charge of possession of drug paraphernalia on petition of probation officer Derek George for testing positive for a controlled substance and failing to submit to a urine screen.Judge Steven R. Serfass resentenced her to serve 90 days to 12 months in the county prison effective Jan. 5.Troy Rehrig,29, of Palmerton, had his probation revoked on a charge of retail theft on petition of probation officer Kimberly Cooper for failing to report to the probation office as directed, failing to keep in contact with Cooper, whereabouts were unknown and testing positive for opiates.Judge Joseph J. Matika resentenced him to serve one day less 12 to one day less 24 months in the county prison effective Feb. 19 and the sentence will run consecutive to another sentence he is already serving.James Smiley, 44, Palmerton, had his parole/probation revoked on a charge of criminal mischief for violating conditions by failing to report to the probation office as directed, testing positive for amphetamine, failing to report for a scheduled urine screen, his drug and alcohol treatment status is unknown and violating the zero-tolerance condition.Serfass resentenced him to serve six to 12 months in the county prison and must serve the entire 12 months.Leanna Altemose, 30, of Palmerton had her probation revoked on a charge of possession of drug paraphernalia for violating conditions by testing positive for suboxone, which violated the zero-tolerance condition.Nanovic resentenced her to serve 90 days to 12 months in prison effective Dec. 7, 2015. Before her release she must submit a pre-parole plan, have drug and alcohol and mental health evaluations arranged, and failure to complete those evaluations would be a further violation of her release.Jacob Bloss,20, of Beaver Meadows, had his probation revoked on a charge of criminal trespass on petition of probation officer Joseph Bettine for violating conditions by not making a concerted effort to pay court costs.Matika resentenced him to serve one to three months in the county prison effective 9 a.m. June 1.If he completes 25 hours of community service and pays $400 on his court costs, along with regular monthly payments, the order will be vacated.John Wuest,40, of Weatherly, had his probation revoked on a charge of simple assault on petition of Bettine for violating conditions by not making a concerted effort to pay court costs and failing to complete 50 hours of community service.Matika resentenced him to serve three to six months in prison effective 9 a.m. June 1. However, if he completes the community service work and pays $595 on his costs, plus his regular monthly payments, the order will be vacated.Randy Gressler, 51, of Lehighton, had his probation revoked on a driving under the influence charge on petition of probation officer Toby Butz for violating conditions by being delinquent in court costs.Serfass resentenced him to serve one to three months in prison effective June 1. However, if he pays $1,381.33 in court costs by that date the order will be vacated.ARD revocationsThe following defendants had their placement in the Accelerated Rehabilitation Disposition probation program revoked.Danielle Beers, 26, of Palmerton, had her placement revoked on a receiving stolen property charge on petition of Cooper for violating conditions by not paying court costs and failing to complete 50 hours of community service.Edward Hoppel,25, of Palmerton, had his placement revoked on a charge of DUI of a controlled substance on petition of Cooper for violating conditions by testing positive for marijuana and methamphetamine.Tylar Romanishan, 21, of Palmerton, had his placement revoked on a charge of DUI of a controlled substance on petition of Cooper for violating conditions by testing positive for marijuana on four occasions.Nicholas Sickonic, 44, of Palmerton, had his placement revoked on a charge of possession of a controlled substance on petition of Cooper for violating conditions by being arrested on new criminal charges and convicted of them.Nicholas Kopp, 29, of Lansford, had his placement revoked on a charge of DUI on petition of probation officer Clifford Eckhart for violating conditions by testing positive for a controlled substance, failing to submit to drug screens and failing to complete drug and alcohol treatment.All five had their cases placed on the next available trial list.
