Two drove drunk with kids in vehicles

Two defendants who drove drunk while they had young children in their vehicle were sentenced to county prison terms Tuesday in Carbon County court.

Judge Steven R. Serfass, saying, "We are seeing too much of this in the county," concerning people driving drunk with children, imposed a longer than mandatory minimum in one case and sentenced the second defendant to an extended term.Jim Thorpe incidentJavier Jose Garcia, 41, of Malvern, Chester County, and formerly of Palmerton, was sentenced to serve 25 days to six months in prison on a DUI charge. At the time of the vehicle stop by Jim Thorpe police on Oct. 5, 2014, along Lehigh Avenue, Garcia had his son, then 11, and his daughter, 9, in the vehicle with him. Garcia refused to submit to a blood test at the time.Serfass asked the defendant, "Do you think it's a good idea to have your children in your vehicle in your condition?"Garcia told the court, "It was not a very proud moment."Serfass told Garcia that he knows the mandatory minimum for the charge under the law is 72 hours, but added, "I feel a longer period of incarceration is appropriate considering the circumstances."In addition to the jail term, Serfass ordered Garcia to pay a fine of $1,500, have his license suspended for 18 months, and render 100 hours of community service. He was given credit for five days spent in jail on the charge. He will begin the jail term on Feb. 26 at 7 p.m. and serve it on consecutive two-day weekends.Controlled substanceSamuel William Lazarchick, 36, of Lehighton, was sentenced to serve jail time on a DUI count and also endangering the welfare of a child. Serfass sentenced him to serve 90 days to 60 months on the DUI count and four to one day less 24 months on the endangering count, with the terms running concurrently.Lazarchick was arrested on July 16, 2015, along Route 248 in Bowmanstown by state police at Lehighton. A test revealed the presence of a controlled substance.At the time of the stop, Lazarchick had his 4-year-old child in the car. He admitted smoking marijuana before driving the vehicle.Lazarchick told Serfass he went to pick up food and his child wanted to go with him.Serfass said, "I hear this all the time. You should have thought of the consequences of smoking marijuana and driving a vehicle with a child in the car."Lazarchick told the court, "I realize what I did. I ruined what I have done in my life and will pick up the pieces and start over." He said he is seeking counseling for his problem of smoking marijuana.In addition to the jail term, Serfass ordered Lazarchick to pay a fine of $1,500, have his license suspended for 18 months, zero tolerance for drug and alcohol use and render 100 hours of community service when released on parole. He will begin the jail term on Feb. 25 at 5 p.m. and serve it in consecutive three-day increments.Both defendants must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole.Both previously pleaded guilty to the charges.
