Transferred case

A case started in Philadelphia County has been transferred to the Carbon County Court as per a stipulation of the parties.In the case, Michael Kovich, Philadelphia, has filed a two-count claim against the Allstate Property and Casualty Insurance Company, Northbrook, Illinois, concerning a motor vehicle accident.The complaint states Kovich was operating a motor vehicle on or about Aug. 3, 2014, on Interstate 76 in Philadelphia when a second vehicle driven by a Jeffrey Brown, identified in the suit as a tortfeasor, collided into the Kovich vehicle, causing the plaintiff to suffer serious, severe and permanent bodily injuries.In one count, the plaintiff charges Allstate with providing Underinsured Motorist's Coverage, alleging it provided insufficient coverage to adequately compensate him for damages, seeking judgment in excess of $50,000 but not more than $75,000, and in a second count, the plaintiff is seeking judgment in the amount of the $5,000 personal injury protection benefit allowed in the policy, plus interest, attorney's fees and costs. A jury trial is demanded.Municipal lien filedPenn Forest Township has filed a municipal lien claim against Paul E. and Linda M. Carlson, 134 Pin Oak Drive, Jim Thorpe.The claim is based upon unpaid garbage fees the township states the defendants owe, including $200 for 2015-16 and $1,154.50 for 2014 and prior years, plus costs.The judgment totals $1,401.15.Complaint in ejectmentThe Federal Home Loan Mortgage Corporation, Coppell, Texas, has filed a complaint in ejectment against John Doe and/or the tenant/occupant of a property at 190 Dead End Lane, Lehighton.The complaint states the plaintiff acquired title to the property by reason of a Sheriff's Sale conducted by the Carbon County Sheriff on Oct. 9, 2015, and that persons are in possession of the premises without right or claim to title.The plaintiff is asking the court for a judgment order of immediate possession and issuance of a writ of possession of the property.Mortgage foreclosuresLakeview Loan Servicing LLC, Coral Gables, Florida, has filed a mortgage foreclosure complaint against Kevin and Lori McLaughlin, 435 E. Patterson St., Lansford, over a property at that address.The complaint seeks judgment in the amount of $51,415.21, plus interest, attorney's fees and costs.The LSF9 Master Participation Trust, Oklahoma City, Oklahoma, has filed a mortgage foreclosure complaint against unknown surviving heirs of the late William J. and Denise M. Wilkinson, 37 Main St., Junedale, over a property at that address.The complaint seeks judgment in the amount of $106,667.39, plus interest, attorney's fees and costs.Hospital bill unpaidThe Remit Corporation, Bloomsburg, as an assignee of the Blue Mountain Health System, has filed a civil action against Kathy Wanamaker, 821 Franklin Ave., Palmerton, seeking payment of a hospital bill the plaintiff states is outstanding.The complaint states Wanamaker received medical treatment, services and/or supplies at the Palmerton Hospital and Gnaden Huetten Memorial Hospital, Lehighton, from May 14, 2012, to Sept. 30, 2014, and contends the defendant violated three counts of the law, breach of contract, breach of implied contract and unjust enrichment, by not paying the bill.Judgment in the amount of $23,122.10, plus interest and costs, is sought.POA files actionThe Mount Pocahontas Property Owners Association, 386 Old Stage Road, Albrightsville, has filed a civil action against John Wasyliw, 59 Minisink Trail, Albrightsville, seeking dues it says the property owner in that development owes.The complaint states it has invoiced Wasyliw for appropriate dues allowable under the Uniform Planned Community Act, but he has refused to pay the costs, which are used for the maintenance of roads, lanes and rights of way in the development.Judgment in the amount of $12,375.32 is sought, plus interest, costs and attorney's fees.
