It is asking the court to enter an order enjoining the defendant from having any lien or title claim to the property and ordering the prothonotary to mark satisfied and discharged the mortgage on the property.The Northeast Investors Group Inc., 1933 Route 903, Jim Thorpe, filed a quiet title action against Wells Fargo Bank N.A., successor by merger to Wachovia Bank, N.A., Des Moines, Iowa, over a property at 47 Red Fox Court, Blue Heron Development, Lake Harmony, Kidder Township.The plaintiff states it became owner of the property by virtue of a purchase from the Sheriff of Carbon County on April 10, 2015, and that there are currently two open mortgages on the property held by Wachovia Bank against the previous owner of the property, Richard Porta. It is asking the court to enter an order enjoining the defendant from having any lien or title claim to the property and ordering the prothonotary to mark satisfied and discharged the mortgage on the property.David Keller, 1933 Route 903, Jim Thorpe, has filed a quiet title action against the Christiana Trust, West Palm Beach, Florida, over a property at 25 Evergreen Road, Franklin Township.The plaintiff states it became owner of the property by virtue of a Carbon County Tax Claim Sale on Sept. 25, 2015. It is asking the court to enter an order enjoining the defendant from having any lien or title claim to the property and granting the plaintiff a writ of possession on the property.Zoning appealJoseph F. and Kyra Choti, Stockton, New Jersey, have filed an appeal of a decision of the Kidder Township Zoning Hearing Board over two parcels of land located in Lake Harmony.The appeal states the couple sought a special exception/conditional use permit to construct an 8-by-12-foot shed on a vacant lot front property located across the street from their dwelling, seeking a variance of the 40-foot minimum setback requirement in the township's ordinance.They couple alleges the board erred in denying their request for use and dimensional variances and erred in denying their request for the realigning of the lake front lot lines for an existing nonconforming lot.The plaintiffs allege the board's decision is arbitrary, capricious and an abuse of discretion, asking the court to reverse the action and approve the couple's request for the lot realignment.Judgment appealedTD Bank, USA N.A., as successor in interest to Target National Bank, Carnegie, Pennsylvania, has appealed a magisterial district judge's decision in favor of the defendant, Catherine E. Barone, HC 3 Box 3231, Albrightsville.Magisterial District Judge Edward M. Lewis, Jim Thorpe, ordered the judgment in favor of Barone on Dec. 15, 2015.
