A, Palmerton, filed the action against Lucas B. Boyd and Carol A. Heffelfinger, both of 166 Delaware Ave., Palmerton, on behalf of her 14-year-old minor child who was a passenger in a vehicle operated by Boyd on Stone Ridge Road in the township.The petition states Boyd was driving at a high rate of speed and failed to control the vehicle, which struck a large boulder and concrete brick column before overturning, resulting in serious and grievous injuries to the minor.The plaintiff states the Nationwide Property and Casualty Insurance Company, which insured the vehicle owned by Heffelfinger, grandmother of Boyd, initially paid the first $5,000 of the minor's medical bills resulting in the first party benefits being exhausted. Subsequently, the remainder of the victim's hospital bills were paid by AmeriHealth Mercy (D.P.W.), which has a $131,550.06 lien against the plaintiff, whose counsel, John R. Vivian, Esq., of Easton, has attempted to negotiate.The pleadings state the plaintiff has negotiated a settlement with the insurance company regarding the $100,000 limits of liability listed in the insurance coverage.Judge Nanovic signed the order distributing the funds as follows: counsel fees to Atty. Vivian, $25,000; costs incurred in preparation of the litigation, $601.68; payment of outstanding DPW lien, $37,199.16; and funds designated to minor, to be placed in a restricted interest-bearing account, $37,199.16.Municipal lienThe Borough of Beaver Meadows filed a municipal lien claim against individuals for not paying unpaid water bills.Named as defendants are Patrick P. and Robbie Lynn B. Bloss, owners of a property at 121 Berwick St. The lien is in the amount of $672.04.Mortgage foreclosureCarrington Mortgage Services, Anaheim, California, has filed a mortgage foreclosure complaint against Josephine Lowery, Ridgewood, New York, over a property at 21 Highpoint Drive, Albrightsville.Judgment in the amount of $108,207.53, plus interest, attorney's fees and costs is being sought.Judgments recordedA judgment entered in Lehigh County was filed in Carbon by Desire Frantz, Orefield, against Matthew R. Moyer, 131 Fairview St., Lehighton.The judgment was entered by Magisterial District Judge Michael J. Faulkner of Allentown, in the amount of $3,188.80, which includes a civil judgment of $3,000 and $188.80 in filing and service fees, plus costs.Midland Funding LLC, Philadelphia, has filed two transcripts of judgment against Amanda Raub, 946 Edgemont Ave., Palmerton, which were entered in October by Magisterial District Judge William Kissner, Palmerton.In both cases, Midland states it is the owner of credit card accounts with Raub by virtue of assignment of the account, during which time the defendant defaulted.One judgment is in the amount of $1,268.26, including a civil judgment of $1,179.26 and $89 in filing fees, while the second judgment is in the amount of $897.03, including a civil order of $808.03, plus $89 in filing costs.
