Carbon County Court - DUI

Five defendants entered guilty pleas on Monday to driving under the influence charges in Carbon County court.

Judge Joseph J. Matika accepted the pleas from the following:Michael Bentz, 25, of Norristown, Montgomery County, was arrested on May 9 along Maury Road, in Penn Forest Township by state police at Lehighton. A test showed the presence of a controlled substance.Matika sentenced him to serve five days to six months in prison, fined $300, one-year license suspension, zero tolerance for drug and alcohol use, and render 25 hours of community service.On a charge of possession of drug paraphernalia, which he also pleaded, he was placed on probation for six months consecutive to the DUI charge, and render an additional 25 hours of community service.Bentz was given credit for 58 days spent in an inpatient rehabilitation program and paroled.Matthew David Pasquale, 20, of Fogelsville, was arrested on July 19 along Main Lane by Lehighton police. A test showed 0.16 BAC.A first offense, he was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.Susan Kennedy, 52, of Philadelphia, was arrested on May 22 along Fourth Street by Lehighton police. A test showed the presence of a controlled substance.Sentencing was deferred so Kennedy could obtain a comprehensive drug and alcohol evaluation.Clark Allen Brown Jr., 51, of Kunkletown, was arrested on June 4 along Route 248 at Palmerton by state police at Lehighton. A test showed the presence of a controlled substance.Matika sentenced him to serve 72 hours to 6 months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service. He will begin the jail term at 9 a.m. on Nov. 20.Jerry Dean Seiler, 40, of Lehighton, was arrested on March 8 along Route 248 at Bowmanstown by state police at Lehighton. A test showed 0.16 BAC.Sentencing was deferred so Seiler could obtain a comprehensive D&A evaluation. Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
