Man involved in fight at bar pleads guilty

A Lehighton man involved in a fight at a Carbon County bar entered a guilty plea last week in the county court to assault and related charges before Judge Steven R. Serfass.

Cody Albert Meserve, 29, pleaded to one count each of simple assault, resisting arrest and persistent disorderly conduct for an incident on March 7 at Ruby's Saloon, Bridge Street, in Lehighton. In a plea bargain a charge of aggravated assault was dropped.Police responded to the scene and learned that Meserve and a Brandon Buck were involved in a fight. When officers attempted to take Meserve into custody he resisted. Police said they had to use a taser on him twice and they sprayed him with pepper spray.Defense Attorney Jennifer Rapa told Serfass that Meserve served a long stint in the military and returned home and suffers from post traumatic stress disorder, noting it is a condition many who have served become victims of.She said since the incident Meserve received help from the Veterans Administration Hospital program and has not have any problems since.Meserve told Serfass, "This was a wake up call for me. Going through this has been a hard time but I glad to get it over with."Serfass sentenced him on the simple assault charge to serve 1 to 1 day less 24 months in the county prison with credit for 59 days spent in jail on the charge and paroled him. Additionally, Serfass ordered Meserve to get a drug and alcohol evaluation, render 100 hours of community service, and make total restitution of $2,025.77.On the other two counts he was placed on probation for a year with the terms running concurrent to each other but consecutive to the assault charge plus another 150 hours of community service for a total of 250 hours.
