ALLENTOWN, Pa. (AP) - A Pennsylvania man who sped through a red light and caused a crash that killed his mother, another woman and her teenage son was spared jail time Wednesday.
John Mayer was sentenced to two years' probation following his conviction last month on three counts of recklessly endanger another person in the February 2013 crash in Whitehall Township, Lehigh County.
Mayer, 34, of Slatington was acquitted of more serious counts of vehicular manslaughter and involuntary manslaughter.
"That night was the worst night of my life," he told the victims' family. "It tore me apart. It just keeps tearing me apart." He also told the judge that he has no desire to ever drive again.
Authorities say Mayer's pickup was going 86 mph in a 30 mph construction zone when he ran a red light and hit a sedan, killing 16-year-old George Gonzalez and 42-year-old Sharon Gonzalez. Virginia Mayer, 60, died five months later.
Prosecutors had argued that Mayer hadn't taken his anti-seizure medication that morning, ignoring the possibility that he might have a seizure.
Chief Deputy District Attorney V. Paul Bernadino said Mayer had had at least 14 seizures over the previous five years, and knew that they were triggered by stress, lack of sleep and not having taken his medication. He alleged that all three factors were present, but Mayer still chose to drive his mother to a hardware store and Chinese buffet.
"A perfect storm was brewing and he turned the key to the ignition," Bernadino said.
Defense attorney Joshua Karoly, however, denied that his client had missed any doses, citing test results that he had a "therapeutic level" of medication in his blood shortly after the crash.
Judge Kelly Banach called the case "absolutely a tragedy all around" and said she knew that the sentence was "unsatisfactory."
"Criminal court isn't the cure all for every bad thing that happens," Banach said. "We can't fix what happened. This can't be fixed."
