Charges against a Monroe County man accused of the indecent assault of a woman have been bound over to Carbon County Court.
Rodney Decker, 49, of East Stroudsburg, was scheduled to have a preliminary hearing Wednesday before District Judge William Kissner of Palmerton.Instead, Decker waived his right to the hearing and is scheduled to appear at 1 p.m. May 14 for a pretrial status conference in the district attorney's office at the courthouse in Jim Thorpe.Decker faces charges of indecent assault and harassment.He remains free on release of own recognizance.According to an affidavit of probable cause filed by Detective Kevin Buck of the Palmerton Police Department:At 9:49 p.m. Feb. 15, Buck was dispatched to Delaware Avenue to speak with a woman in reference to being assaulted.The woman said she had a service technician at her apartment earlier in the day to fix a problem with her cable unit.The victim said the service tech completed his work and left, but she began receiving text messages from the man, later identified as Decker.She said these text messages were referencing Decker returning to the apartment for coffee.Decker returned at 5:45 p.m., and she let him into the apartment. While standing in the kitchen area, the victim said Decker began to force himself on her.On Feb. 17, Decker arrived at Palmerton Police Department for a scheduled interview. Decker denied the allegations, and said she had leaned in to kiss him.Buck asked Decker if he would be willing to submit to a polygraph exam, and he said he would.On March 2, Decker took a polygraph exam at the state police Lehighton barracks. Decker was again given his Miranda rights, which he signed and waived, agreeing to speak with Buck.He told police allegations were accurate, but that he may have only brushed against her.
