Driver gets jail for DUI with kids in car

A Berks County driver was given a Carbon County prison term on Tuesday for driving drunk while he had his children in the vehicle.

He was one of five defendants who previously pleaded guilty to be sentenced by President Judge Roger N. Nanovic II.DUI chargeJoshua Joel Damore, 40, of Boyertown, was sentenced to serve 30 days to six months in prison on a driving under the influence charge.Damore was arrested on Feb. 6, 2013, along Little Gap Road in Lower Towamensing Township by state police at Lehighton after being involved in a crash. Given a test, the result showed the presence of a controlled substance. At the time of the stop Damore had his children in the vehicle.Nanovic rejected a request to sentence Damore to the mandatory minimum of two days because of the children in the vehicle.In addition to the jail term Damore must pay a fine of $1,000, and an 18-month license suspension.On a summary offense of driving under suspension he was fined $200.He will begin the jail term on March 6 at 5 p.m. and serve it on consecutive alternating weekends.Other casesDavid A. Kocis, 50, of Lehighton, was placed on probation for six months on a DUI charge. He was arrested on March 15, 2014 by state police at Lehighton, in Franklin Township following a vehicle stop. A test revealed a 0.04 BAC and the presence of a controlled substance.He was also ordered to pay a fine of $300, zero tolerance imposed for D&A use, and continue his aftercare program. The term runs consecutive to a six-month probation term he is currently serving in Columbia County for another DUI.On a summary offense of turning movements, he was fined $25 and costs.Robert Harrison Bunch, 30, of Palmerton, was sentenced to serve 72 hours to six months in jail on a DUI charge. He was arrested on Aug. 1, 2014, along Route 209 in Towamensing Township by state police at Lehighton. A test showed the presence of a controlled substance.He was also fined $1,000 and his license suspended for a year.He will begin the jail term at 9 a.m. on March 2.Tyler Robert Billings, 22, of Palmerton, was placed on probation for a year on a charge of accidents involving damage to an attended vehicle or property.He was arrested by Palmerton police after being involved in an accident, in which he struck another vehicle and property.He was also ordered to get a drug and alcohol evaluation, zero tolerance imposed on D&A use, and must pay restitution for damages in the crash totaling $6,320.04.The term runs consecutive to a prior probation sentence of one year.Immediately after being sentenced Billings was arrested by sheriff's deputies on a detainer filed by the adult probation office and transported to the county prison.Samantha Lynn Ealey, 26, of Bath, Northampton County, was sentenced to serve 48 hours to six months in jail on a DUI charge. She was arrested on June 26, 2014, along Lehigh Avenue by Palmerton police. Given a test, the result was 0.30 BAC.She must also send 28 days in the Intermediate Punishment Program with electronic monitoring following the jail term, pay a fine of $1,500, and a one year license suspension.She started the jail term at 5 p.m.All defendants must also pay court costs of about $1,500, and pay a $50 per month supervision fee while on probation or parole.
