Jury: Man endangered young girl Grandfather is found guilty

A Carbon County man faces prison time after a Schuylkill County jury decided on Thursday that he had endangered his granddaughter in May 2014 in Pottsville.

The jury of six men and six women deliberated almost three hours before finding Troy M. Fairchild Sr., 42, of Lehighton, guilty of recklessly endangering another person and not guilty of simple assault.Judge James P. Goodman, who presided over Fairchild's one-day trial, found him guilty of harassment.Goodman ordered preparation of a presentence investigation and scheduled Fairchild's sentencing for March 11. He allowed the defendant to remain free on $10,000 unsecured bail pending sentencing.Pottsville police had charged Fairchild with endangering Addison Fairchild and harassing the child's mother, Caitlin Boyer, on May 1, 2014, during a dispute outside Dollar General, 200 E. Arch St., in the city. Addison Fairchild was in a stroller at the time, police said."Troy Fairchild came up behind me, grabbed me by the waist and pulled me down. He had his hands around my waist and pulled me and my daughter down," Boyer testified. "My daughter was in the middle of this."Boyer said the altercation was not a mutual fight and denied it had anything to do with the custody dispute between her and Derek Fairchild, the defendant's son and the father of the child.State police Trooper Michael V. Ryan testified he saw the squabble while driving down Route 61."Are you concerned for the child?" Assistant District Attorney William L.J. Burke asked Ryan."Yes," Ryan said."Is there any order to the scene?""No."The defendant testified Boyer had started arguing with his wife, Tina Fairchild, and he intervened to help Addison Fairchild."I did nothing to cause any injury to may granddaughter," he said when questioned by his lawyer, Mark A. Barket of Pottsville.Troy Fairchild also said he tried to get his granddaughter out of the stroller before she was hurt. He said her foot got caught in the stroller, and when he let go, Boyer, who was holding the child, fell on top of Tina Fairchild.Derek Fairchild testified Boyer refused to turn the girl over to him, even though he had primary custody of her, but said Boyer started the argument.Tina Fairchild testified Boyer had started yelling at her.
