Carbon County judges conducted probation/parole revocation hearings on petitions filed by the county adult probation office.

The probation office filed petitions against the defendants for violating the terms of their probation or parole.The revocation hearings were held for the following:Benjamin Kunkel, 37, of Lansford, had a petition filed to revoke his parole filed by probation officer Clifford Eckhart on a charge of theft. He was sentenced on May 23, 2012, on the charge.Eckhart said Kunkel violated his parole by being charged with a new criminal offense, has repeatedly tested positive for controlled substances, has failed to submit to scheduled drug screens, and failed to engage in a drug and alcohol treatment.On July 22 Judge Steven R. Serfass found Kunkel in violation and revoked his parole. He was resentenced to serve six months back time in the county prison with credit for serving 107 days.Brian Wardell, 23, of Albrightsville, had a petition filed by probation officer Joseph J. Berke to revoke his parole on a charge of theft. He was sentenced on Sept. 20, 2011, on the charge.Berke said Wardell violated his conditions of release by admitting he took unprescribed percocet, is delinquent on his court costs, violated the zero tolerance provision, and failed to obtain drug and alcohol treatment.On June 27 President Judge Roger N. Nanovic found him in violation and revoked his parole. He was remanded to the county prison to serve four months.Phillip Zuber, 41, of Nesquehoning, had a petition filed by Eckhart to revoke his parole on a charge of driving under the influence (DUI). He was sentenced on Feb. 19. He violated his parole by testing positive for alcohol, and violated the zero tolerance provision.On July 22 Judge Joseph J. Matika revoked his parole and recommitted him to the county prison to serve 90 days back time. He was given credit for 67 days already spent in the prison on the charge.Thomas Verrastro, 22, of Hazleton, had a petition filed by probation officer Matthew J. Kimmel to revoke him from the Accelerated Rehabilitation Disposition (ARD) probation program for violating conditions. He was placed in the program on June 21, 2012, on a charge of DUI.Judge Serfass ruled he violated the program and ordered the revocation be effective on Dec. 1. However, if Verrastro completes the highway safety program and provides proof of his drug and alcohol treatment, pays is court costs in full, and completes his community service work by Dec. 1, the revocation order will be vacated.Jonathan Montalvo, 25, of West Chester, had a petition to revoke him from the ARD program filed by Kimmel for violating conditions. He was placed in the program on June 28, 2011, on a DUI charge.Judge Serfass revoked him from the program, effective Dec. 1. However, if he completes the highway safety program and drug and alcohol treatment by Dec. 1 the order will be vacated.
