Lansford man facing charges

Jeffrey D. Biggs, 39, of 430 E. Bertsch St., Apt. 316, Lansford, faces charges from an incident which took place on Feb. 2 on the 200 block of W. Bertsch St. in the borough. Biggs is charged with furnishing alcohol to minors and public drunkenness.

According to an affidavit of probable cause, here's what happened:Officer Jason Helmer was duty at 9 p.m. when he, along with officer Amie Barclay, were dispatched to the area of 17 W. Bertsch St. on a report of several intoxicated people walking down the street. It was reported that a male had fallen and hit his head and may have been injured.While en route, the officers encountered a group of people walking west in the 200 block of West Bertsch Street. Helmer saw a male being supported by two others; they appeared to be staggering and visibly intoxicated. Upon making contact the officers saw the male had visible facial injuries. The male, who identified himself as Biggs, said he had fallen on the street.Helmer smelled a strong odor of alcoholic beverage coming from Biggs' mouth and about his person. Biggs slurred his words, and was having difficulty balancing.Contact was made with a female, who was also visibly intoxicated. She was identified as Nicole Christman, and told police she was 18. She also had difficulty speaking without slurring her words and was having difficulty maintaining her balance.Biggs was arrested for public drunkenness. Barclay arrested Christman for underage drinking and public drunkenness. She was issued citations, and taken to a relative's house.At the police station, Helmer was unable to verify Biggs' identity with the information he had provided. Biggs told Helmer he had left his wallet at home. Helmer took Biggs to his apartment, where Biggs invited him to come inside while he retrieved his wallet.Helmer saw the obvious signs of a recent drinking party in the apartment: a haze of cigarette smoke, open beer cans littering the floor, glasses full of whiskey, empty liquor bottles, a trash can overflowing with empty beer cans.Biggs admitted that the group had been partying there, and that he had supplied the alcohol. He said he didn't know Christman was under 21.Helmer released Biggs, with the understanding that he would interview him when he was sober.At 5:25 p.m. Feb. 3, Helmer went to Biggs' apartment and asked him to come in for the interview. Biggs voluntarily agreed to come with Helmer, and was informed that he was not under arrest.At the station Biggs said he didn't remember what had happened the night before. He did remember hosting a birthday party, involving beer and Jack Daniels, earlier in the day. Biggs told Helmer he assumed that everyone attending was of legal drinking age and that everyone had been helping themselves to the alcoholic beverages.Biggs was advised of his Miranda rights, which he opted not to waive, and declined to provide a written statement.At 7:46 p.m. police interviewed Christman, who gave a written statement that she attended her sister's birthday party at Biggs' apartment, and had drunk alcoholic beverages there.
