A Tamaqua man who was almost shot by police on April 15, after brandishing a realistic looking BB gun at Boyer's Food Mart in Tamaqua, elected to waive his right to a preliminary hearing on May 3. The hearing was scheduled before District Judge Stephen Bayer.

Gino Cicioni, 44, faces charges of possession of an instrument of crime, making terroristic threats, resisting arrest, simple assault, reckless endangerment and disorderly conduct. The charges were file by Tamaqua Patrolman Peter Wysochansky.Bail remained set at $50,000 straight cash bond and Cicioni was returned to the Schuylkill County Prison in Pottsville.Other cases scheduled to be heard before Judge Bayer included:Andre W. Hewett, 36, of 535 Court St., Reading, waived a hearing on charges filed by Tamaqua Patrolman Thomas Rodgers. Hewett was charged with driving under the influence of alcohol following an April 7 incident.He was released on $2500 straight cash bail.Joshua James Ohl, 30, of 369 W. Water St., Lansford, was scheduled for a hearing on charges of possession of a controlled substance with intent to deliver and possession of a controlled substance. The intent charge was withdrawn by arresting officer Rush Township Patrolman Corey Herring. The other charge was waived to court. The charges stem from a March 6 incident.Ohl was released on $25,000 unsecured bail.Matthew Thomas Edmonds, 22, of Hazleton, waived a hearing on charges filed by Coaldale Patrolman Charles Blesse. Charges of possession of a controlled substance, possession of drug paraphernalia and possession of marijuana were waived to court, while a count of possession of a controlled substance with intent to deliver was withdrawn. The charges stem from an April 4 incident.Edmonds was released after posting ten percent of the imposed $10,000 bail.
