Woman gets jail time for theft of funds from elderly victim
A woman who used her power of attorney to transfer almost $200,000 of an elderly woman's bank account for her own personal use was sentenced to 10 monlths in the Schuylkill County Prison Monday. She was one of seven who were sentenced by Judge Cyrus Palmer Dolbin. All had entered guilty pleas on Sept. 3 with the sentencing deferred so presentence investigation reports could be prepared by the adult probation office.
Elizabeth M. Deleon, 44, of Port Carbon, was sentenced to serve 10 to 23 months on a charge of theft by unlawful taking of personal property beginning Monday, Nov. 30, at 10 a.m. On a second count of theft by taking a car owned by the victim she must serve an additional nine months on probation after she is released from prison and on a third count of theft she must serve an additional 12 months on probation.Deleon was also ordered to make restitution of $204,159.80 to the estate of the late Margaret E. Palko, Orwigsburg, who was confined in the Schuylkill Center Nursing Home, and pay $55,178.88 to the nursing home for Palko's stay at the home.Others sentencedJason Nathan Bredbenner, 25, last known address, Shenandoah, on a charge of stalking was sentenced to serve 24 to 48 months in a state correctional institution and on a charge of criminal mischief by slashing tires on the car of Sidney Wentworth, Shenandoah, was ordered to make restitution of $1,213 to the victim.Patricia Hook, 46, Minersville, on charges of retail theft from various stores in King's Village, Minersville, and involved in a hit and run accident, was given credit for serving 57 days in the county prison and was placed on probation for three years.Daniel L. Tiboni, 24, Drums, Luzerne County, was sentenced on a charge of driving under the influence (DUI) of alcohol to serve 90 days to five years in the county prison beginning Tuesday, Nov. 17, at 10 a.m., pay a fine of $5,000, $300 to Substance Abuse Education fund and $50 to Criminal Justice Enhancement fund.Medhat S. Ammar, 19, of Danville, on charges of simple assault, reckleslsy endangering another person at the Nittany Apartments, Schuylkill Campus of Penn State University in North Manheim Township, was placed on probation for 23 months, pay $50 to the Criminal Justice Enhancement fund and make restitution of $10,877 to the victim, Jonahan M. Drebitko, for injuries suffered.Christopher Kelly Phelan Jr., 26, Lost Creek, West Mahanoy Township, on a DUI charge was sentenced to serve 48 hours to six months in the county prison beginning Wednesday, Nov. 11, at 10 a.m., pay a fine of $500, $100 to the Substance Abuse Education fund, $50 to the Catastrophe fund, $60 to the Schuylkill Medical Center and his drivers license suspended 12 months. On three summary charges, operating an a all terrain vehicle on streets or highways, failling to operate in a safe manner and failing to have his ATV registered was fined $25 each plus $150 in costs.Kamar Dockwey, 42, Pottsville, on a DUI charge was placed in the Intermediate Punishment Program (IPP) for six months with electronic monitoring for the first 15 days and the remainder on probation, pay a fine of $1,000, $300 to the Substance Abuse Education fund, $50 to the Catastrophe fund and her license is suspended 12 months.Justin M. Marx, 19, Cumbola, formerly of Port Carbon, on a charge of theft and hit and run accident was placed on probation 12 months, pay $50 to the Criminal Justice Enhancement fund and restitution of $2,577.67 from the hit and run accident with his ATV in Port Carbon.
